imprisonment in a 2019 defamation case. The disqualification was instant because of the Supreme Court of India\u2019s judgment in Lily Thomas vs Union of India (2013).\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Provisions_for_disqualification_of_a_Member_of_Parliament\"><\/span><strong>Provisions for disqualification of a Member of Parliament:<\/strong>&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Article 102:<\/strong> It specifies that a person shall be disqualified for contesting elections and being a Member of Parliament under certain conditions mentioned as following:\u00a0<ul><li>Holding an office of profit\u00a0<\/li><li>Being of unsound mind or insolvent\u00a0<\/li><li>Not being a citizen of India\u00a0<\/li><li>It also authorizes Parliament to make law determining conditions of disqualifications.\u00a0<\/li><\/ul><\/li><li><strong>The Representation of the People Act, 1951:<\/strong>\u00a0<ul><li>It provides that a person will be disqualified if convicted and sentenced to imprisonment for two years or more.\u00a0<\/li><li><strong>Section 8(1):<\/strong> It provides the offences punishable under the Representation of People Act, 1951.\u00a0<\/li><li><strong>Section 8(2):<\/strong> It provides for the conviction of member in the offences related to hoarding or profiteering, adulteration of food or drugs, and any provision of the Dowry Prohibition Act.\u00a0<\/li><li><strong>Section 8(3):<\/strong> It says that a person convicted of any offense other than those mentioned in the other two clauses, and sentenced to not less than two years shall be disqualified from the date of conviction, decided by the President under Article 103. However, it doesn\u2019t directly say they\u2019re disqualified instantly.\u00a0<\/li><li><strong>Section 8(4):<\/strong> It has exempted sitting members from instant disqualification for three months to enable them to appeal against the conviction. <strong>This clause was struck down as ultra vires in the Lily Thomas vs Union of India, 2013<\/strong>.\u00a0<\/li><\/ul><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Lily_Thomas_vs_Union_of_India_2013\"><\/span><strong>Lily Thomas vs Union of India, 2013:<\/strong>&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li>The <strong>Supreme Court removed Section 8(4)<\/strong> because Parliament can\u2019t treat lawmakers who are found guilty differently. This is because Article 102(1) says lawmakers and candidates should be treated the same way.&nbsp;<\/li><li>However, when it comes to treating them differently, the Constitution actually allows it. <strong>Article 103<\/strong> says that for current lawmakers, the <strong>President will decide if they should be disqualified under Article 102(1)<\/strong>.&nbsp;<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rahul_Gandhi_Case\"><\/span><strong>Rahul Gandhi Case:<\/strong>&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>The Supreme Court stayed the conviction:<\/strong> It did not express any opinion on the question of whether a stay of conviction is also necessary or on suspending the disqualification.&nbsp;<\/li><li>The Court observed, if the period of imprisonment was less by one day the disqualification would not have occurred.&nbsp;<\/li><li><strong>Lok Sabha Secretariat cannot declare disqualified without referring the case to the President under Article 103 for a declaration<\/strong>. Politicians belonging to the powerful ruling dispensation at a particular time are be able to get a conviction stayed within a few hours, thus saving themselves from instant disqualification.\u00a0<\/li><li><strong>Section 8(4) needs to be restored and protected constitutionally<\/strong> in order to protect the careers of India\u2019s legislators from abrupt convulsions caused by court orders which are given, in the words of the Supreme Court, \u201cwithout any application of mind\u201d.\u00a0<\/li><li>The <strong>law on criminal defamation needs an urgent review<\/strong>.
