It is based on the principle of \u2018separation of power\u2019 where court proceedings are according to the \u2018rule of law\u2019 without any fear, favour or influence.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Body\"><\/span>Body&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Judicial_independence_is_a_prerequisite_for_democracy_because_it\"><\/span>Judicial independence is a prerequisite for democracy because it:&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Upholds rule of law:<\/strong> Judicial independence upholds the rule of law in democracy, where all, including the government, are bound by the law. Independent judges impartially interpret and apply the law, preventing abuse of power and ensuring equal treatment for all citizens.&nbsp;<\/li><li><strong>Ensures supremacy of law<\/strong>.(part of basic structure doctrine as mandated by Kesavananda Bharati case)&nbsp;<\/li><li><strong>Safeguarding individual rights:&nbsp;<\/strong><\/li><\/ol>\n\n\n\n<ul class=\"wp-block-list\"><li>Expanded scope of article 21 in Maneka Gandhi case(1978)&nbsp;<\/li><li>Addressed sexual harassment issue in Vishakha case(1997)&nbsp;<\/li><li>Right to sexual autonomy, privacy and equality in Navtej Singh Johar case(2018)&nbsp;<\/li><li>Right to privacy as fundamental right held in Puttaswamy case(2017)&nbsp;<\/li><\/ul>\n\n\n\n<ol class=\"wp-block-list\" start=\"4\"><li>Facilitates dispute settlement as the final interpreter of the constitution.&nbsp;<\/li><li>Check on dictatorship: Minerva Mills case (1980) held some provisions of 42nd amendment act as unconstitutional.&nbsp;<\/li><\/ol>\n\n\n\n<p><strong>Therefore keeping in mind the importance of judicial independence, the constitutional framers guaranteed it by:<\/strong>&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Financial independence of judges by non-adjustment of their emoluments.(article 125(2))&nbsp;<\/li><li>Removal of judges only on President\u2019s proclamation and on proven grounds of misbehavior and incompetence (articles 124,217)&nbsp;<\/li><li>Judges to be appointed in consultation with the senior most judges(article 124(2); currently the collegium of judges.&nbsp;<\/li><li>State to work towards separation of executive and judiciary (article 50)&nbsp;<\/li><li>Contempt of court provisions to maintain the sanctity of courts.
