However, it only restricted affirmative action to American Indians or Indians living on or near a reservation.\u00a0<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_issue_in_focus\"><\/span><strong>The issue in focus<\/strong>&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Harvard employs a highly selective admissions process<\/strong> that entails a student\u2019s grades, recommendation letters, or extracurricular involvement.\u00a0\u00a0<\/li><li>However, the final stage of the application process placed candidates on a list containing their \u201c<strong>legacy status, recruited athlete status, financial aid eligibility, and race<\/strong>\u201d.\u00a0\u00a0<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_case\"><\/span><strong>The case:<\/strong>\u00a0<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>The SFFA had filed lawsuits <\/strong>arguing that the <strong>race-based admissions programs violate Title VI of the Civil Rights Act of 1964 and the Equal Protection Clause of the Fourteenth Amendment<\/strong> (individuals in similar situations be treated equally by the law).\u00a0<\/li><li>While the former prohibits discrimination based on race, colour, and national origin in programs and activities receiving federal financial assistance, the latter refers to the idea that a government body may not deny equal protection of its governing laws to the people.\u00a0\u00a0<\/li><li>The SFFA also alleged discrimination against Asian-American students.\u00a0<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Precedents_till_date\"><\/span><strong>Precedents till date<\/strong>&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li>The practice of <strong>affirmative action was upheld by SCOTUS in its 1978 <\/strong>ruling by a nine-judge bench.&nbsp;<\/li><li>In <strong>2003, came the landmark \u201cGrutter v. Bollinger\u201d ruling<\/strong> holding that colleges could consider race as one factor in admissions because of the compelling interest in creating a diverse student body.\u202f&nbsp;<\/li><li>In the <strong>2016 case of \u201cFisher v.
