in 1976 and amended in 2010 when a slew of new measures was adopted to regulate foreign donations. The act applies to all associations, groups, and NGOs which intend to receive foreign donations. Such contributions can only be <strong>accepted through designated banks.<\/strong>\u00a0\u00a0<\/li><li>Registered associations can receive <strong>foreign contributions<\/strong> for social, educational, religious, economic, and cultural purposes.\u00a0\u00a0\u00a0<\/li><li>Filing of annual returns, on the lines of Income Tax, is compulsory.\u00a0\u00a0\u00a0<\/li><li>In 2015, the MHA notified new rules, which\u202frequired <strong>NGOs to give an undertaking\u202fthat the acceptance of foreign funds is not likely to prejudicially affect<\/strong> the sovereignty and integrity of India or impact friendly relations with any foreign state and does not disrupt communal harmony.\u00a0\u00a0<\/li><li>All NGOs would have to operate accounts in either nationalized or private banks which have core banking facilities to allow security agencies access on a real-time basis.\u00a0\u00a0<\/li><li>In case of <strong>non-compliance<\/strong> with provisions of the FCRA, the <strong>government can penalize<\/strong> an NGO and, subsequently, suspend or cancel its license.\u00a0\u00a0\u00a0<\/li><li>If NGOs do not file annual returns, the government can issue a show-cause notice and, subsequently, suspend or cancel their foreign funding licenses, as it deems fit.\u00a0\u00a0<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Impact_of_Recent_Changes_in_the_Rules\"><\/span><strong>Impact of Recent Changes in the Rules:&nbsp;<\/strong>&nbsp;&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li>Many NGOs <strong>do not have sophisticated finance<\/strong> and legal teams, nor do they have the funds to conduct audits.\u00a0\u00a0<\/li><li>It will create <strong>sharp polarization on the issue between the government<\/strong> and civil society, and even within civil society.\u00a0\u00a0<\/li><li>For a handful of NGOs who may be doing something wrong, many other NGOs are completely paralyzed.\u00a0\u00a0\u00a0<\/li><li>An <strong>enabling environment around foreign funding<\/strong> has so far helped citizens of other countries (especially from the Indian diaspora) donate to causes close to their hearts. With the new FCRA law, international donors (members of the diaspora, international nonprofits, and foundations) will be <strong>discouraged from donating to India<\/strong>.\u00a0\u00a0<\/li><li>People who might have earlier donated to <strong>one nonprofit<\/strong>, which further sub-granted to another ten nonprofits, will now have to disburse grants to these various <strong>nonprofits individually<\/strong>.\u00a0\u00a0<\/li><li>Multinational corporations also typically donate via the FCRA route for their corporate social responsibility projects through sub-granting.\u00a0 The change in FCRA will <strong>disturb ongoing development work in India<\/strong> that is supported by these companies.\u00a0\u00a0<\/li><\/ul>\n\n\n\n<p>By combining donations from <strong>corporate social responsibility<\/strong>, Indian funders, and international donors, the NGO has managed to address gaps in funding till now. With changes to the FCRA Act, funding through many of these routes will now be cut off. Since independence, NGOs have shouldered the responsibilities of nation-building.
