A person who has been the <a href=\"https:\/\/www.drishtiias.com\/daily-updates\/daily-news-analysis\/n-v-ramana-48th-chief-justice-of-india\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Chief Justice of India<\/strong><\/a><a href=\"https:\/\/www.drishtiias.com\/daily-updates\/daily-news-analysis\/n-v-ramana-48th-chief-justice-of-india\" target=\"_blank\" rel=\"noreferrer noopener\"> <\/a>or a judge of the <a href=\"https:\/\/www.drishtiias.com\/important-institutions\/drishti-specials-important-institutions-national-institutions\/supreme-court-of-india\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Supreme Court<\/strong><\/a><a href=\"https:\/\/www.drishtiias.com\/important-institutions\/drishti-specials-important-institutions-national-institutions\/supreme-court-of-india\" target=\"_blank\" rel=\"noreferrer noopener\"> <\/a>is a chairman.&nbsp;<\/li><li>The chairman and members are appointed by the <a href=\"https:\/\/www.drishtiias.com\/daily-updates\/daily-news-analysis\/president-s-rule-in-puducherry\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>President<\/strong><\/a> on the recommendations of a six-member committee consisting of the Prime Minister as its head, the<a href=\"https:\/\/www.drishtiias.com\/to-the-points\/Paper2\/the-office-of-speaker-of-lok-sabha\" target=\"_blank\" rel=\"noreferrer noopener\"><strong> Speaker of the Lok Sabha,<\/strong><\/a> the Deputy Chairman of the Rajya Sabha, leaders of the Opposition in both the <a href=\"https:\/\/www.drishtiias.com\/daily-updates\/daily-news-analysis\/parliament-sessions-1\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Houses of Parliament<\/strong><\/a><a href=\"https:\/\/www.drishtiias.com\/daily-updates\/daily-news-analysis\/parliament-sessions-1\" target=\"_blank\" rel=\"noreferrer noopener\"> <\/a>and the Union Home Minister.&nbsp;<\/li><li>The chairman and members hold office for a term of <strong>three years or until they attain the age of 70 years<\/strong>, whichever is earlier.&nbsp;<\/li><li>The <strong>President can remove the chairman or any member<\/strong> from the office under some circumstances.&nbsp;<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Role_of_NHRC_as_an_Effective_Complement_to_the_Judiciary_and_other_institutions\"><\/span><strong>The Role of NHRC as an Effective Complement to the Judiciary and other institutions:<\/strong>&nbsp;&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li>The National Human Rights Commission is an example of \u201c<strong>fourth branch institutions<\/strong>.\u201d The other three branches are the legislature, the executive, and the judiciary, with each branch acting as a check and a balance upon the others.&nbsp;&nbsp;&nbsp;<\/li><li>Under the Protection of Human Rights Act, the Human Rights Commissions are <strong>empowered to<\/strong> inquire into the violations of human rights committed by state authorities, either upon petitions presented to them or upon their own initiative.&nbsp;&nbsp;&nbsp;<\/li><li>During the inquiries, the Commissions are <strong>granted identical powers to that of civil courts.<\/strong>&nbsp;&nbsp;<\/li><li>These proceedings are deemed to be judicial proceedings, and they require that any person, who may be prejudicially affected by their outcome, has a right to be heard.&nbsp;&nbsp;<\/li><li>The commission <strong>has its own nucleus of investigating staff<\/strong> for inquiry into complaints of human rights violations.&nbsp;&nbsp;&nbsp;<\/li><li>It is empowered to utilize the services of any officer or investigation agency of the Central government or any state government for the purpose.&nbsp; It has also established effective cooperation with the NGOs with first-hand information about human rights violations.&nbsp;&nbsp;<\/li><li>It can also visit any jail or any other institution under the control of the State Government to see the conditions of the inmates and to make recommendations on it.&nbsp;&nbsp;<\/li><li>The commission can review the safeguards provided under the Constitution or any law for the protection of human rights and can recommend remedial measures.&nbsp;&nbsp;<\/li><li>It also undertakes and promotes research in the field of human rights.&nbsp;&nbsp;<\/li><li>It works to spread human rights literacy in society and promotes awareness of the safeguards available for the protection of these rights through media, publications, seminars, and other means.&nbsp;&nbsp;<\/li><li>The commission has the authority to recommend payment of compensation or damages.&nbsp;&nbsp;<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Limitations_of_the_NHRC\"><\/span><strong>Limitations of the NHRC:&nbsp;<\/strong>&nbsp;&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Investigation Mechanism:<\/strong> NHRC does not have any mechanism of investigation.
