Arvind Kejriwal to the Enforcement Directorate\u2019s (ED\u2019s) custody in connection with the <strong>excise policy case<\/strong>.&nbsp;<\/li><li>CM Kejriwal became the <strong>first serving CM<\/strong> in the country to be arrested.&nbsp;<\/li><li>Two cases, one by CBI and one on alleged money laundering being investigated by ED, have been registered in relation to the excise policy.&nbsp;<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_a_sitting_chief_minister_be_arrested\"><\/span><strong>Can a sitting chief minister be arrested?<\/strong>&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"No_immunity_to_CM\"><\/span><strong>No immunity to CM<\/strong>\u00a0<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Article 361 of the IC<\/strong>: The <strong>President of India<\/strong> and <strong>governors<\/strong> are immune from <strong>civil and criminal<\/strong> proceedings during their term.&nbsp;<\/li><li>However, this protection <strong>doesn\u2019t extend<\/strong> to <strong>Prime Ministers<\/strong> and <strong>Chief Ministers<\/strong>.&nbsp;<\/li><li>The <strong>Administrator or Lt<\/strong>.<strong> Governor (LG) of a Union Territory<\/strong> is <strong>not immune<\/strong> under Article 361.&nbsp;<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_an_MLACM_be_arrested_during_the_session_of_the_Legislative_Assembly\"><\/span><strong>Can an MLA\/CM be arrested during the session of the Legislative Assembly?<\/strong>&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Section 135A of the CPC:<\/strong> It <strong>exempts<\/strong> <strong>members of legislative bodies<\/strong> (Parliament, Legislative Assembly (LA)\/Councils, LA of any UT) from arrest and detention under the <strong>civil process<\/strong>\u2013&nbsp;<\/li><li>During the continuance of <strong>any meeting<\/strong> of such House of Parliament or, as the case may be, of the Legislative Assembly or the Legislative Council&nbsp;<\/li><li>During the continuance of any meeting of such <strong>committee<\/strong>,&nbsp;<\/li><li>During the continuance of a <strong>joint sitting<\/strong>,<strong> meeting<\/strong>,<strong> conference <\/strong>or<strong> joint committee<\/strong> of the Houses of Parliament or Houses of the State Legislature, as the case may be,&nbsp;<\/li><li>During the <strong>forty days<\/strong> <strong>before and after<\/strong> such a meeting, sitting or conference.&nbsp;<\/li><li>However, there is <strong>no exemption<\/strong> as such for <strong>criminal processes<\/strong>.&nbsp;<\/li><li>MP or MLA\/MLC does not enjoy any immunity from being arrested in a criminal case, during the session, or otherwise.&nbsp;<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Privileges_for_MPs_and_MLAs\"><\/span><strong>Privileges for MPs and MLAs<\/strong>&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Member_of_Parliament\"><\/span><strong>Member of Parliament<\/strong>&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Article 105(1):<\/strong> <strong>Freedom of Speech<\/strong> in Parliament.&nbsp;<\/li><li><strong>Article 105(2)<\/strong>: Immunity to a Member from any proceedings in any court with respect to <strong>anything said or any vote given<\/strong> by him in Parliament or any Committee thereof.&nbsp;<\/li><li>MPs and MLAs are <strong>not immune<\/strong> to criminal prosecution on <strong>bribery charges<\/strong> related to their votes or speech in Parliament or state assemblies.&nbsp;<\/li><li><strong>Article 105(2)<\/strong>: Immunity to a person from proceedings in any court with respect to the <strong>publication<\/strong> by or under the authority of either House of Parliament of <strong>any report<\/strong>,<strong> paper<\/strong>,<strong> votes or proceedings<\/strong>.&nbsp;<\/li><li><strong>Article 122(1)<\/strong>: Prohibition on the Courts to <strong>inquire<\/strong> into the validity of any proceedings in Parliament on the grounds of any alleged <strong>irregularity of procedure<\/strong>.&nbsp;<\/li><li><strong>Section 135A of the Code of Civil Procedure<\/strong>,<strong> 1908<\/strong>&nbsp;<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Members_of_the_Legislative_Assembly\"><\/span><strong>Members of the Legislative Assembly<\/strong>&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Section 135A of the Code of Civil Procedure<\/strong>,<strong> 1908<\/strong>&nbsp;<\/li><li><strong>Articles 194(2):<\/strong> Grants legislators\u2019 immunity from legal proceedings concerning their speeches and votes in Legislative Assemblies.&nbsp;<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_a_chief_minister_run_for_office_from_behind_bars\"><\/span><strong>Can a chief minister run for office from behind bars?<\/strong>&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Legal Framework:<\/strong>&nbsp;<\/li><\/ol>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Section 8 of the Representation of the People Act<\/strong>,<strong> 1951<\/strong>: According to the law, a Chief Minister can only be disqualified or removed from office when <strong>convicted<\/strong> in any case.&nbsp;<\/li><li>In the case of Arvind Kejriwal, he has <strong>not been convicted yet<\/strong>.&nbsp;<\/li><li>The Chief Minister can lose the top job under only three conditions \u2013&nbsp;<\/li><li><strong>Loss of majority support<\/strong> in the assembly.&nbsp;<\/li><li>Through a successful <strong>No-Confidence Motion<\/strong> against the government.&nbsp;<\/li><li>He <strong>resigned<\/strong> from the position.&nbsp;<\/li><\/ul>\n\n\n\n<ol class=\"wp-block-list\" start=\"2\"><li><strong>Basic Norms for Holding Public Office:<\/strong>&nbsp;<\/li><\/ol>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Manoj Narula versus Union of India Case<\/strong>,<strong> 2014:<\/strong> The SC mentioned that basic norms for holding a public office include <strong>constitutional morality<\/strong>,<strong> good governance<\/strong>,<strong> and constitutional trust<\/strong>.&nbsp;<\/li><li><strong>Public officials<\/strong> are expected to act in a manner consistent with these principles.&nbsp;<\/li><li>The citizens expect persons in power to uphold high standards of <strong>moral conduct<\/strong>.&nbsp;<\/li><li>This expectation is particularly high for CM, which is seen as the repository of public faith.&nbsp;<\/li><\/ul>\n\n\n\n<ol class=\"wp-block-list\" start=\"3\"><li><strong>Practical Difficulties of Functioning from Jail:<\/strong>&nbsp;<\/li><\/ol>\n\n\n\n<ul class=\"wp-block-list\"><li>They may face restrictions on <strong>accessing official documents<\/strong> or <strong>communicating<\/strong> with government officials.&nbsp;<\/li><li>There may also be questions about whether they can <strong>effectively fulfil their duties<\/strong> while in custody.&nbsp;<\/li><\/ul>\n\n\n\n<ol class=\"wp-block-list\" start=\"4\"><li><strong>S. Ramachandran versus V. Senthil Balaji Case, 2023:<\/strong>&nbsp;<\/li><\/ol>\n\n\n\n<ul class=\"wp-block-list\"><li>Even if it\u2019s technically possible for a CM to run the government from jail, there may be concerns about the <strong>legitimacy and effectiveness of their leadership<\/strong> under such circumstances.&nbsp;<\/li><li>The HC raised the question of whether an individual should receive a <strong>salary from the public purse<\/strong> while occupying a public office without performing any associated duties.&nbsp;<\/li><\/ul>\n\n\n\n<ol class=\"wp-block-list\" start=\"5\"><li><strong>President\u2019s Rule:<\/strong>&nbsp;<\/li><\/ol>\n\n\n\n<ul class=\"wp-block-list\"><li>The <strong>Lieutenant Governor<\/strong> can <strong>report<\/strong> to the President to <strong>suspend the operation<\/strong> of <strong>Article 239AA<\/strong>, which governs Delhi, if the LG is satisfied that:&nbsp;<\/li><li>\u201cA <strong>situation<\/strong> has arisen in which the administration of the National Capital cannot be carried on in accordance with Article 239AA\u201d or&nbsp;<\/li><li>\u201cIt is <strong>necessary and expedient<\/strong> to do so for the proper administration of National Capital Territory.\u201d&nbsp;<\/li><li>He can cite the <strong>\u2018failure of constitutional machinery in the state<\/strong>,\u2019 a strong reason for the President\u2019s rule in Delhi under <strong>Article 239AB<\/strong> of the IC.&nbsp;<\/li><li>The President\u2019s rule will bring that national capital under the Union government\u2019s direct control.&nbsp;<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Enforcement_Directorate\"><\/span><strong>Enforcement Directorate:<\/strong>&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li>The ED is a <strong>multi-disciplinary organisation<\/strong> mandated to investigate offences of <strong>money laundering<\/strong> and <strong>violations of foreign exchange laws<\/strong>.&nbsp;<\/li><li>The Enforcement Directorate was established in 1956 as an \u2018<strong>Enforcement Unit<\/strong>\u2019 under the Department of Economic Affairs.&nbsp;<\/li><li>Later, in 1957, this Unit was renamed as \u2018Enforcement Directorate\u2019.&nbsp;<\/li><li>It functions under the <strong>Department of Revenue<\/strong> of the <strong>Ministry of Finance<\/strong>.&nbsp;<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Structure\"><\/span><strong>Structure:<\/strong>&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Headquarters<\/strong>&nbsp;<\/li><\/ol>\n\n\n\n<ul class=\"wp-block-list\"><li>ED, which has its headquarters in <strong>New Delhi<\/strong> and is headed by the <strong>Director of Enforcement<\/strong>.&nbsp;<\/li><li>Five <strong>regional offices<\/strong> are located in <strong>Mumbai<\/strong>,<strong> Chennai<\/strong>,<strong>
