The law is the system of rules recognized by a particular country or community to regulate the actions of its people, which are enforced by the imposition of penalties. A law could be an individual rule as part of a system of law.
Any society is governed by certain sets of laws and rules. Although in common language, these are synonyms yet there is substantial difference between them, which are as follows:
- Applicability: Laws are generally applicable for an entire country or community except the exempted areas and exempted people. Rules are applicable for any kind of society, institution, association or any activity.
- Creation: In a democratic country, laws are made by the elected representatives or legislatures. Rules can be set up by individuals or made by a secretary of any association, private institutions and establishments, etc.
- Consequence: Every citizen of a country must adhere to the laws framed by the legislature. Not adhering to laws can lead to strict and severe consequences such as imprisonment. Not following or adhering to the rules can often lead to mild consequences such as the payment of an amount as fine, suspension, etc.
- Nature and Scope: Laws are more strict in nature when compared with rules. Moreover, rules are broader in scope when compared to laws.
Role of ethics in formulating Laws and Rules:
- For effective governance of the country, laws are made by the parliamentarians. These laws should be guided by ethical standards which the society and nation opt for. Ethics and laws work simultaneously to ensure that citizens act in a certain manner and also make sure that these coordinated efforts protect the health, safety and welfare of the public.
- Ethics is the guiding light that defines sound moral conduct and practices that ought to be followed by the individuals. This calls for framing of rules and regulations on the lines of ethics. For example, several institutions, business establishments etc. start their day by paying reverence to the almighty, a sort of ethical conduct. Several corporate houses, go beyond the legalised limit of Corporate Social Responsibility (CSR) and work for the disadvantaged sections of society just because their rules have a sound ethical backing.
Ethics are indistinguishably intertwined with laws and rules when their rationales and objectives overlap to recognise common standards of professional conduct. Laws can’t be shared on the basis of personal values, principles, and purposes, though rules can be premised on them if they are not subject to an enforceable standard of behaviour.Ethics helps in framing the code of conduct in a society which is essential to its functioning, for example: the Indian Constitution. In modern societies, the systems of law and rules are closely related to ethics in that they determine and enforce definite rights and duties.
