According to the National Commission to Review the Working of Constitution’s (NCRWC, 2002) report on ‘Probity in governance’, an important prerequisite for ensuring probity in governance is the absence of corruption. The other requirements are effective laws, rules, and regulations governing every aspect of public life and, more importantly, an effective and fair implementation of those laws, etc. Thus it involves adopting an ethical and transparent approach, allowing the process to withstand scrutiny.

Steps to ensure probity in governance are:
- Need to promote e-governance (through the use of Information and Communication Technology) for transparency. It would also help in anonymous complaints against public servants by ordinary people.
- Need to work on behavioral change in bureaucrats through training, performance appraisal, and inculcation of values like empathy and compassion.
- Need for a law providing for the confiscation of illegally acquired assets of public servants.
- Need to strengthen the criminal justice system.
- Enactment of the Public Interest Disclosure Act – to strengthen the Whistleblower’s Protection Act and RTI Act etc are also necessary.
- A sense of discipline needs to be instilled by the heads of organizations and leaders of society.
A mix of adequate rules and regulations, creating favorable administrative processes, and development of ethical competence are desirable to ensure probity in governance. Excessive dependence must not be on external mechanisms because it always keeps a prospect to breach but the focus must be on creating men of strength and character who uphold such values on their own. Apart from laws and policies, the government should also focus on bringing behavioral change in government employees so that they can easily empathize with the problem of the common mass to fulfill the democratic goal of “government by the people, for the people and to the people”.
